Tel Aviv, Israel-based El Al Israel Airlines Ltd. may have plenty of available seats on its Boeing 787 aircraft from the United States (primarily routes to New York City and Washington DC) to Tel Aviv and from Tel Aviv to the United States, but this excess capacity will soon be less so as personal injury attorneys begin traversing the Atlantic and into courtrooms.

Why? 

There are the estates of 1,200 potential clients in the State of Israel, United States, and other countries who will file civil claims against the government of the State of Israel- including individuals in leadership.  However, the 1,200 is not the true value because those 1,200 individuals left relatives- immediate and distant.  They too will want compensation. 

Then there are the estates of approximately 15,500 individuals subject to Palestinian Authority jurisdiction, directly or indirectly, who will file civil claims against the government of the State of Israel- including individuals in leadership.  However, the 15,500, which is certainly to continue to increase as the Israel Defense Forces (IDF) continue operations in Gaza, is not the true value because those 15,500 individuals left relatives- immediate and distant.  They too will want compensation.  

Along with the State of Israel, defendants in various jurisdictions will certainly include the organization Hamas and the Palestinian National Authority (PA) and, perhaps the government of State of Qatar (2023 foreign reserves approximately US$50 billion), which permits representatives of the organization Hamas to operate within its territory.  There will likely too be criminal charges brought before courts within the State of Israel and in territories internationally-recognized as under the administrative control of the PA, along with civil filings and criminal filings before internationally-recognized tribunals, including the International Criminal Court (ICC) in The Hague, Netherlands.

On 7 October 2023, there were approximately 1,200 individuals subject to State of Israel law, including dual nationals, and other nationalities who were murdered by individuals directly or indirectly connected with the organization Hamas.

Since 7 October 2023, the Israel Defense Forces (IDF), at the direction of the government of the State of Israel, has been responsible for approximately 15,500 deaths and approximately 40,652 injuries in the territory of Gaza, according to the Ministry of Health of Gaza, which has been controlled since 2007 by the organization Hamas.  Of the 15,500 deaths, the Ministry of Health of Gaza reports that approximately 70%, or 10,850 are women and children.

On 9 September 2001, four civilian aircraft were hijacked.  Two of the aircraft targeted the two World Trade Center towers in New York City.  One of the aircraft targeted the Pentagon, the primary location of the United States Department of Defense (DOD).  One of the aircraft did not reach its anticipated target (The White House or United States Capitol) and crashed into a field located in the Commonwealth of Pennsylvania.

September 11th Victim Compensation Fund of 2001 was created by the United States Congress with taxpayer funds.  It distributed approximately US$7 billion to survivors and victims' families.  The September 11th Victim Compensation Fund of 2001 commenced distributing compensation eleven days after the program was established and began issuing checks in April 2002 until the program expired by statute in June 2004.  LINK To Report By United States Department Of Justice Office of the Inspector

  • Mr. Kenneth Feinberg, a Washington DC-based attorney (www.feinberglawoffices.com) specializing in mediation and alternative dispute resolution, served as Special Master for the September 11th Victim Compensation Fund of 2001 and TARP Executive Compensation; Administrator of the BP Deepwater Horizon Disaster Victim Compensation Fund; and was retained to assist in the General Motors recall response and compensation for Volkswagen owners. 

“At the end of the process approximately US$7 billion was awarded to 97% of the families.  A non-negotiable clause in the acceptance papers for the settlements was that the families were to never file suit against the airlines for any lack of security or otherwise unsafe procedures.”

“Of 2,977 victims who lost their lives as a result of the attack, only one survivor’s family has refrained from settling its claims with the airline and a security company they say were negligent.”   Ninety-four 94 families who lost a relative on 11 September 2011 opted not to participate in the September 11th Victim Compensation Fund of 2001 and decided voluntarily to litigate in New York City, New York.  Ninety-three families of those ninety-four families eventually reached settlements.

There have been 2,983 families of those who died and received an average of just over US$2 million tax-free per claim.  Approximately 2,300 physically injured 9/11 victims or those who suffered from respiratory problems cleaning up the World Trade Center were each awarded US$400,000.00 tax-free, on average.

The Iraq Example

The United States Central Command (CENTCOM) initially determined compensation for individuals subject to Republic of Iraq jurisdiction was not “culturally appropriate” and civilians could not file claims for their losses.  In September 2003, the government of the United States amended that position and authorized condolence payments.  These payments were drawn from the Commander’s Emergency Response Program (CERP) and could be paid out for death, injury, or property damage due to United States government combat operations.

“In Iraq, commanders and Judge Advocates in the field exercised significant control and discretion over payments.  Payments for death were generally capped at US$2,500.00 and payments for injuries ranged from a few hundred dollars to US$2,500.00.  The upper limit of a condolence payment was US$2,500.00, though in exceptional instances payments could be more.  A General in Iraq, for example, could approve a payment of US$10,000.00 for an individual death, though there was no evidence that level of payment was delivered.”
